1. About these terms
These terms apply when you use the Saadhan Charge app, the operator dashboard or this website (together, "the service"), operated by Aarambha IT ("we", "us"). By creating an account or using the service, you agree to them and to our privacy policy. If you don't agree, please don't use the service.
Saadhan Charge is a platform. The charging stations on it are owned and run by independent charge point operators ("operators"), who set their own prices and are responsible for their stations and chargers.
2. Your account
- You must be at least 16 years old, and old enough to enter a contract under Nepali law, to have an account.
- You sign up with your own mobile number and confirm it with an SMS code. Give accurate details and keep them up to date.
- Keep your password and your RFID cards safe. You are responsible for charges started with your account or cards until you tell us or the operator that they were lost or misused.
- One person, one account. Don't share your account or sell it.
3. Charging
- You start a charge by scanning the charger's QR code, choosing a free connector in the app, or tapping your RFID card. A charge needs enough balance on the card you use.
- Follow the instructions at the station and on the charger. Use only connectors suited to your vehicle, and don't leave cables in a dangerous state.
- You can stop a charge from the app or the charger. It may also stop when the battery is full, when it reaches a target you set, when your balance runs out, or if the charger or the grid has a fault.
- Charging time, cost and battery level shown before and during a charge are estimates. Your vehicle, the weather, the charger and the grid all affect them.
- Move your vehicle once charging ends, so others can charge. Operators may set rules for parking and idle time at their stations.
4. Prices and billing
- Each operator sets the price at its stations. Prices are usually per kWh, may change by time of day, and may include a service charge or taxes. The app shows the current rate before you start.
- You pay for the energy measured by the charger's meter for your session, at the rate that applied when it was delivered. The amount is taken from the card or wallet used to start the charge.
- Your history in the app shows each session with its energy, cost and transaction number. If you think a charge is wrong, tell the operator or us within 30 days, with the transaction number. We'll look into it with the operator and correct any mistake.
5. Wallets, cards and top-ups
- An operator card is issued by an operator and works at that operator's stations. Its balance is held and managed by that operator.
- A Super Card is issued by the Saadhan Charge team and works at every station on the platform. We settle with each operator for the energy used at its stations.
- Balances are prepaid credit for charging. They are not a bank deposit, don't earn interest, and can't be exchanged for cash or moved to another person, except where an operator or we agree to it, or the law requires it.
- Refunds of unused balance are handled by whoever issued the card: the operator for an operator card, and us for a Super Card. Contact them with your card number.
- When you delete your account, your cards stop working and any balance left on them is lost. Please use or ask about your balance first.
6. Using the service properly
You agree not to:
- use another person's account, card or mobile number without permission;
- tamper with chargers, cables, QR codes or the app, or try to charge without paying;
- try to break into, overload or reverse engineer the service, or scrape it automatically;
- use the service for anything illegal, or to harass or harm others.
We may suspend or close an account that breaks these rules, and operators may refuse service at their stations.
7. Charge point operators
Operators and their staff use the service under a separate agreement with us, which sets out fees, payouts and responsibilities. In addition to these terms, operators are responsible for their stations, chargers, prices, staff access, and for following Nepali law, including electrical safety and consumer protection rules. Operators must keep their customers' data confidential and use it only to run their charging business.
8. Availability
We work to keep the service running, but we can't promise it will always be available or free of errors. Charger status in the app comes from the chargers and can be out of date. Stations may be busy, closed or out of order, and the internet or power may fail. We may update, change or stop parts of the service, and will give notice of significant changes when we can.
9. Liability
- Operators are responsible for their stations and chargers, and for any damage they cause. We are responsible for the app and platform.
- As far as Nepali law allows, we are not liable for indirect losses (such as lost time, missed trips or lost profit), or for problems caused by chargers, vehicles, the grid, internet providers or other things outside our control.
- Where we are liable, our total liability to you is limited to the amount you paid for charging through the service in the three months before the problem.
- Nothing in these terms limits rights you have under Nepal's Consumer Protection Act, 2075 (2018), or liability that can't be limited by law.
10. Closing your account
You can delete your account at any time from the app, or by asking us. See how to delete your account. We may close an account that breaks these terms or that has been inactive for more than two years, after warning you where we can. Sections 4, 5, 9 and 11 continue to apply after an account is closed.
11. Law and disputes
These terms are governed by the laws of Nepal, including the Electronic Transactions Act, 2063 (2008). If you have a complaint, contact us first and we'll try to solve it quickly. If we can't, disputes will be settled by the courts of Nepal.
We may update these terms. We'll change the date at the top, and tell you in the app before a significant change takes effect. Using the service after that means you accept the new terms.
